Popisem v katalogu tudíž cestovní kancelář v zákaznících vzbudila přesvědčení, že koupat se v moři je možné přímo u hotelu. Nezáleží přitom na tom, zda žalobce musel k přístupu do moře jít pěšky nebo zda tam mohl dojet kyvadlovým autobusem či jinou veřejnou dopravou.
